Although cops use the psychological tactic of “good cop/bad cop” when interviewing suspects, it is also a good technique that you can use if you’re stopped by police.
The worst thing you can do when stopped by police is become aggressive and confrontational…aka don’t be a “bad cop.” Even if a cop stops you illegally or accuses you of something you didn’t do, showing your “bad cop” side will only hurt your case.
The best thing you can do when stopped by police is to (1) shut up and (2) be nice, polite, and calm…aka be a “good cop.” It may be frustrating to keep your cool, but here are two reasons why it’s important:
- Everything you do is likely recorded on the officer’s body camera. If a prosecutor watches a video with a rude cop and a nice citizen, the prosecutor may dismiss the charge or give a favorable plea deal.
- Let your attorney be the bad cop! When we question an officer on the witness stand, we get to be aggressive and confrontational. We get to confront and question the cop about his illegal arrest or expose his shoddy investigation.
If you’re stopped by a cop, shut up and play “good cop.” When you go to court with us, we’ll fight for you and be your “bad cop.”
